Violation of any of the above prohibitions may result in the immediate termination of your access to the Site and Services, and we reserve the right to refer such violations to appropriate law enforcement authorities.

5. Orders, Pricing, and Payment Terms
5.1 Placing Orders
By placing an order through our Site, you represent that you are authorized to make the purchase and that the payment information you provide is accurate and complete. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at any time, including after confirmation, due to product unavailability, pricing errors, suspected fraud, or other legitimate reasons.
5.2 Pricing
All prices listed on the Site are in United States Dollars (USD) and are subject to applicable sales taxes, delivery fees, and any other applicable charges. Prices are subject to change at any time without notice. In the event of a pricing error on the Site, we reserve the right to cancel the affected order and notify you accordingly. We will not be obligated to fulfill an order at an incorrect price.
5.3 Payment
Payment must be made at the time of placing your order through the payment methods available on our Site. By providing payment information, you authorize Pizza Luce to charge the applicable amount to your chosen payment method. All payment transactions are processed by third-party payment processors, and we do not store your full payment card information on our servers.
5.4 Refunds and Cancellations
Cancellations and refunds are handled on a case-by-case basis at the sole discretion of Pizza Luce. Once an order has been confirmed and food preparation has commenced, we may not be able to cancel or refund the order. 5.5 Delivery and Pickup
Estimated delivery and pickup times are provided as a courtesy and are not guaranteed. Various factors outside our control, including traffic conditions, weather, and high order volumes, may affect delivery times. We shall not be liable for any delays in delivery or failure to deliver within estimated timeframes.
6. Intellectual Property Rights
All content on the Site, including but not limited to text, graphics, logos, images, photographs, menu descriptions, design elements, software, audio clips, video clips, and the overall look and feel of the Site (collectively, "Content"), are the exclusive property of Pizza Luce or its licensors and are protected by applicable United States intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.), trademark laws, and other applicable intellectual property statutes.
The Pizza Luce name, logo, and all related trademarks, service marks, trade names, and trade dress are the exclusive property of Pizza Luce. Nothing in these Terms grants you any license or right to use any trademark, service mark, logo, or trade name of Pizza Luce without our prior written consent.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial use in connection with placing orders and utilizing our Services. This license does not include the right to:

- Use any data mining, robots, or similar data gathering and extraction tools.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIZZA LUCE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, MENU INFORMATION, PRICING, OR AVAILABILITY.
- WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.
Pizza Luce does not warrant or represent that food items are free from allergens or that our menu information is complete with respect to allergen content. Customers with food allergies or dietary restrictions are strongly encouraged to contact us directly before placing an order to discuss their specific needs.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, IN NO EVENT SHALL PIZZA LUCE, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, OR SUCCESSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, goodwill, or business opportunities.
- Personal injury or property damage related to your use of the Services.
- Unauthorized access to or alteration of your transmissions or data.

- Delays or failures in delivery of orders.
IN NO EVENT SHALL PIZZA LUCE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF PIZZA LUCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its officers, directors, employees, agents, contractors, licensors, service providers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorneys' fees) arising from or related to:
- Your use of and access to the Site and Services.
- Your violation of any provision of these Terms.
- Your violation of any third-party rights, including any intellectual property, privacy, or proprietary rights.
- Any claim that your use of the Services caused damage to a third party.
- Your violation of any applicable federal, state, or local law or regulation.
- Any content or information you submit, post, or transmit through the Site.
- Your fraudulent or deceptive conduct in connection with the use of the Services.
This indemnification obligation will survive the termination or expiration of these Terms and your use of the Site and Services. Pizza Luce reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with our defense of such matter.
10. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which Pizza Luce is registered and primarily operates, without regard to its conflict of law provisions.
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site and Services shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States, and you hereby consent to the personal jurisdiction and venue of such courts.
These Terms are subject to applicable federal laws of the United States, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce, and the Computer Fraud and Abuse Act (18 U.S.C. § 1030). Nothing in these Terms limits your rights under applicable consumer protection laws that cannot be waived by agreement.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact Pizza Luce first and attempt to resolve any dispute informally. Please send a written description of your dispute to [email protected] with the subject line "Dispute Notice." We will make good-faith efforts to resolve the matter within thirty (30) days of receiving your notice.
11.2 Binding Arbitration
If the parties are unable to resolve a dispute informally within thirty (30) days, any and all disputes, claims, or controversies arising out of or relating to these Terms, the Site, or the Services (including questions about the scope or applicability of this arbitration clause) shall be resolved through binding arbitration administered by a recognized arbitration body in accordance with its applicable rules. The arbitration shall take place in the United States, at a location to be mutually agreed upon by the parties or as determined by the arbitrator. The arbitrator's decision shall be final and binding and may be enforced in any court of competent jurisdiction.
11.3 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST PIZZA LUCE. All disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
11.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction for disputes that fall within the jurisdictional limits of such court, provided the matter remains in that court and is not removed or appealed to a court of general jurisdiction.
12. Third-Party Links and Services
Our Site may contain links to third-party websites, applications, services, or resources that are not owned or controlled by Pizza Luce. These links are provided solely for your convenience and informational purposes. Pizza Luce has no control over, and assumes no responsibility for, the content, privacy policies, practices, or terms of service of any third-party sites or services.

Pizza Luce shall not be liable for any loss or damage caused or alleged to be caused by or in connection with your use of or reliance on any content, goods, or services available through any third-party site or service.
13. Food Allergen and Dietary Information
Pizza Luce takes food safety seriously. However, we cannot guarantee that any menu item is completely free from allergens, including but not limited to gluten, nuts, dairy, eggs, soy, wheat, fish, or shellfish. Our kitchen handles multiple food items, and cross-contamination is always a possibility.

Pizza Luce shall not be liable for any adverse reactions resulting from failure to disclose food allergies or dietary requirements at the time of ordering.

The parties further agree that any such invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that achieves, to the greatest extent possible, the same purpose and economic effect as the replaced provision.
18. Waiver
The failure of Pizza Luce to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Pizza Luce. No waiver by Pizza Luce of any breach or default of these Terms shall be deemed to be a waiver of any preceding or subsequent breach or default.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by Pizza Luce on the Site, constitute the entire agreement between you and Pizza Luce regarding your use of the Site and Services, and supersede all prior and contemporaneous communications, representations, and agreements, whether oral or written, between you and Pizza Luce relating to the same subject matter.
You acknowledge that you have not relied upon any representation, warranty, or undertaking not expressly set out in these Terms, and you waive all claims based upon any such representation, warranty, or undertaking.
20. Force Majeure
Pizza Luce shall not be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic events, war, terrorism, civil unrest, labor disputes, governmental actions or regulations, power outages, internet disruptions, or any other event beyond our reasonable control (collectively, "Force Majeure Events").
In the event of a Force Majeure Event, Pizza Luce will use commercially reasonable efforts to resume performance as soon as practicable. Orders affected by Force Majeure Events may be cancelled or delayed, and Pizza Luce shall not be held liable for any resulting loss, damage, or inconvenience.
21. Electronic Communications
By using our Site and Services, you consent to receive electronic communications from Pizza Luce, including but not limited to order confirmations, receipts, account notifications, and promotional materials (subject to your communication preferences). You agree that any agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

22. Assignment
You may not assign or transfer your rights or obligations under these Terms, in whole or in part, without our prior written consent.
